What is an Accredited Specialist?

An Accredited Specialist is a person who is recognised by the Law Institute of Victoria as being an expert in their field of law.

To become accredited, lawyers must have practised for at least five years, and must pass the examination process set down by the Law Institute of Victoria. It is then the Accredited Specialists’ duty to pursue continuing Professional Development to ensure they maintain their accreditation.

What is Collaborative Law?

After operating successfully in the USA, Canada and the UK for many years, Australia is now embracing the practice of Collaborative Law. It is an alternative method of settling your Family Law matter instead of using more traditional and sometimes confrontational approaches which may be more costly and stressful.

The aim of Collaborative Law is to negotiate and ascertain a favourable outcome for both parties without entering the court system. If you choose to use Collaborative Law, you will be required to enter into a contract with your lawyer, your former partner and his or her lawyer to make a genuine effort to resolve your case by not going to court and instead to engage in a series of meetings. In some instances, other professionals may be required to participate in meetings, for example, financial experts, counsellors, psychologists or property valuers. The contract also provides that you must both agree that if you cannot resolve your case by using the Collaborative Law process, then each of your lawyers must withdraw from representing you and you must each instruct new lawyers to issue proceedings in court.

If you are willing to negotiate an agreement by discussing and considering all elements of your family law dispute in an open and cooperative manner, then the Collaborative Law process may be a good option for you to consider.
